By accessing or using the VapeEducate website, online courses, or any related applications (collectively, the "Service"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Service. All published information is subject to modification without advance notice.

1. Licenses & Purchases

VapeEducate course licenses are granted on a per-individual basis. Each license entitles one student to access the designated course for a period of one (1) year from the date of purchase or the date the student's account is activated, whichever is later.

Licenses are available under two models:

Additional licenses may be purchased at applicable bulk rates at any time during the initial license year. Licenses are non-transferable and may not be reassigned to a different student once activated.

2. Refund Policy

All sales are final and non-refundable. Because course access is provisioned immediately upon purchase and student accounts are created automatically, VapeEducate does not offer refunds, credits, or exchanges for any license purchase, including unused licenses in a bulk pack.

If you believe a charge was made in error, please contact us within 30 days of the transaction and we will investigate.

3. Acceptable Use

You agree to use the Service only for its intended educational purpose. You may not:

VapeEducate reserves the right to suspend or terminate access for any user or district that violates these terms without prior notice and without refund.

4. Intellectual Property

All course content, materials, videos, assessments, graphics, text, and other elements of the Service are the exclusive intellectual property of VapeEducate and are protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, publicly display, modify, create derivative works of, or otherwise use any VapeEducate course materials outside of the Service without explicit prior written authorization from VapeEducate.

5. Student Data & Privacy

VapeEducate is committed to protecting student privacy. We collect only the information necessary to create and manage student accounts and track course progress. This includes name, email address, school affiliation, and course completion data.

Student-identifiable information is not sold, rented, or shared with third parties outside of VapeEducate, except as required to deliver the Service or as required by law.

District administrators and school-designated group leaders may view the progress and completion status of students enrolled under their account within the VapeEducate administrator portal.

Schools and districts subject to FERPA or COPPA are responsible for ensuring that appropriate parental consents and data-sharing agreements are in place before enrolling students under the age of 13.

6. Accuracy of Information

VapeEducate makes reasonable efforts to ensure that all course content and informational materials are accurate and up to date. However, the science around vaping and e-cigarettes continues to evolve, and some information may change after publication. We do not warrant that all content is complete, current, or free from error.

Users should independently verify any facts or statistics before relying on them for purposes other than general education.

7. Third-Party Services

VapeEducate delivers its courses through TalentLMS, a third-party learning management system. By using the Service, you also agree to be bound by TalentLMS's Terms of Service. VapeEducate is not responsible for the availability, functionality, or content of any third-party platform or service.

Payment processing is handled by Stripe and QuickBooks. VapeEducate does not store credit card numbers or sensitive payment details on its servers.

The VapeEducate website may contain links to external websites for informational purposes. VapeEducate does not endorse and is not responsible for the content, privacy practices, or reliability of any linked third-party site.

8. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. VapeEducate expressly disclaims all implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

VapeEducate does not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components, or that defects will be corrected.

9. Limitation of Liability

To the fullest extent permitted by applicable law, VapeEducate and its owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Service.

VapeEducate's total liability to you for any claim arising from or relating to the Service shall not exceed the amount you paid for the license or licenses giving rise to the claim in the twelve (12) months preceding the claim.

10. Changes to These Terms

VapeEducate reserves the right to update or modify these Terms & Conditions at any time. When we make material changes, we will update the "Effective" date at the top of this page. Continued use of the Service after changes are posted constitutes your acceptance of the revised terms.
